Terms of Use — ClickChat

SECTION 1Acceptance and terms

By downloading and using the ClickChat application you are deemed to have accepted these Terms of Use. If you do not accept the terms, you must not use the App.

18 age limit ClickChat is intended solely for users aged 18 and over. Use of the App by anyone under 18 is strictly prohibited, and any such accounts that are identified will be closed.

SECTION 2User account and security

You undertake that all information in the profile you create is accurate and belongs to you.
Impersonating another person or providing misleading information results in your account being permanently blocked.
You are responsible for keeping your account password confidential and for all activity carried out through your account.
If you believe an account has been used without authorisation, you must notify the support address immediately.

SECTION 3Community and conduct rules

The following behavior is strictly prohibited:

Messages containing harassment, insults, hate speech, incitement to violence or threats.
Sharing sexual or pornographic images or images that infringe copyright.
Engaging in commercial advertising, spam, gambling referrals or fraudulent activity.
Sharing another user's private information without permission; engaging in persistent and unwanted contact.
Attempting to disrupt the operation of the App, collect data with automated tools or circumvent security measures.

These rules apply to chat, Stories, Feed posts and voice rooms alike. When you see a rule violation, you can use the report and block tools.

Reports are reviewed within 24 hours Zero tolerance applies to inappropriate content and abusive users. Content reported to us through the in-app report tool is reviewed within 24 hours at the latest. Content found to be in breach of the rules is removed; the account of the user who committed the violation is warned, suspended or permanently closed. You can also end your interaction with a user instantly by using the block tool.

SECTION 4Coins, Premium and payments

Sending a message costs coins Photos, location and voice messages are subject to the same charge. With a Premium membership, messages do not cost coins.

Payment channel. All purchases are made through the App Store or Google Play. Your card details are not entered into the App.
Coin packs. These are one-off purchases and do not renew. Once confirmed, all coins including any bonus are added to your balance. Coins cannot be converted into cash or transferred.
Subscription and auto-renewal. Premium renews automatically at the end of the subscription period you selected in the store. To prevent renewal, the subscription must be cancelled at least 24 hours before the end of the current period; otherwise the fee for the new period is charged at the end of the period.
Charging. The fee is charged to your App Store or Google Play account at the moment you confirm the purchase. The renewal fee is likewise taken from the same store account within the 24 hours before the end of the current period. The applicable amount and period are the amount and period you see in the store at the time of purchase.
Cancellation. You can cancel your subscription only through the subscription settings of your App Store or Google Play account; deleting the app or closing your account does not automatically end the subscription. After cancellation, your Premium access continues until the end of the period you have paid for.
Free trial. Where a free trial is offered, if you purchase a subscription to the same content during the trial period, the unused portion of the trial ends and no refund or transfer is made for that portion.
Prices. The applicable amount is the amount you see in the store. Prices may be updated with prior notice.
Refunds. Refund requests are subject to Apple's and Google's refund policies and are handled through the relevant store.

SECTION 5Consumer rights and right of withdrawal

Your in-app purchases qualify as distance contracts within the meaning of Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. At the moment you confirm the purchase, your coin balance or Premium access is made available to you instantly in electronic form.

Exception to the right of withdrawal Pursuant to Article 15/1-(ğ) of the Regulation on Distance Contracts, the 14-day right of withdrawal cannot be exercised for contracts concerning services performed instantly in electronic form and intangible goods delivered instantly to the consumer. As coin packs and Premium subscriptions fall within this scope, there is no right of withdrawal once the purchase is completed.

You may nevertheless submit a refund request. As the fee is collected directly by Apple or Google, refund requests are handled through the relevant store's refund policy and processes; ClickChat is not in a position to refund the fee directly, independently of the store. You can write to us at destek@clickchatapp.com so that we can assess your request and, if necessary, guide you through your process with the store.

Your statutory rights as a consumer are reserved. In the event of a dispute, depending on the monetary thresholds, you may apply to the Consumer Arbitration Committee or the Consumer Court of your place of residence or of the place where the transaction was carried out. The current monetary thresholds for such applications are announced each year by the Ministry of Trade.

SECTION 6Use through the Apple App Store and Google Play

If you downloaded the App through the App Store, the following terms form an integral part of this agreement. In the event of any conflict between this section and the other provisions of the agreement, the provisions of this section shall apply with respect to your relationship with Apple.

Parties to the agreement. These Terms of Use are concluded solely between you and ClickChat (KolekciApps LLC); Apple Inc. is not a party to the agreement. ClickChat alone is responsible for the App and its content.
Scope of the license. The right of use granted to you is non-transferable and is limited to your use of the App on Apple-branded devices that you own or control, in accordance with the Usage Rules set out in the App Store Terms of Service.
Maintenance and support. ClickChat alone is responsible for providing maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
Warranty. The App is provided "as is", without any warranty of any kind, express or implied, to the maximum extent permitted by applicable law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever; any claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the sole responsibility of ClickChat.
Claims. Any claims raised by you or a third party relating to the App — including product liability claims, claims of non-compliance with legal and regulatory requirements and claims arising under consumer protection legislation — are addressed solely by ClickChat; Apple bears no responsibility for such claims.
Intellectual property claims. In the event of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights, ClickChat alone is responsible for the investigation, defense, settlement and discharge of such claim.
Export and sanctions representation. By using the App, you represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third party beneficiary. Apple and Apple's subsidiaries are third party beneficiaries of these Terms of Use. Upon your acceptance of the terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third party beneficiary.

Google Play If you downloaded the App through Google Play, this agreement is likewise solely between you and ClickChat; Google LLC is not a party to the agreement and is not responsible for the App. Downloads and purchases made through Google Play are additionally subject to the Google Play Terms of Service.

SECTION 7Content and responsibility

You are responsible for the content of the photos, text and voice recordings you share. The rights in the content you share remain with you; you grant us a limited permission to use it so that the content can be displayed and stored within the App and the necessary technical operations can be carried out.

Content shared by other users does not reflect ClickChat's views. The consequences arising from communication and meetings between users are the responsibility of the users; we recommend that you take reasonable safety precautions when meeting people you have met on the App.

SECTION 8Intellectual property

All rights in the ClickChat name, logo, interface design and software belong to KolekciApps LLC. Copying the App's source code, reverse engineering it or producing derivative works without permission is prohibited.

SECTION 9Suspension and termination of the account

ClickChat reserves the right to suspend or terminate, without prior notice, accounts that breach the community guidelines or these Terms of Use. For suspended accounts, the reason and, where applicable, the duration are shown within the app.

You can deactivate your account or delete it permanently at any time from the Settings screen. Where you close your account yourself, or your account is terminated for breach of these Terms, unused coin balances and ongoing subscription entitlements are as a rule not subject to a refund; cancelling the subscription through your store account is your responsibility.

By way of exception to this rule, if your account has been terminated unfairly by ClickChat, or your access has been permanently blocked, without any breach of these Terms or of the community guidelines, you may request a refund or compensation for your unused coin balance and for the portion of your subscription corresponding to the unused period. It is sufficient to send your request to destek@clickchatapp.com; as payment is taken through the store, we will support you in the refund process with Apple or Google where necessary. Your rights arising from consumer legislation are reserved in all cases.

SECTION 10Provision of the service and changes

The App is provided "as is". There may be temporary interruptions in the service due to maintenance, updates or technical reasons. Features may be developed, changed or removed; significant changes are announced within the app.

To the extent permitted by applicable law, we cannot be held liable for indirect damages or for claims arising from interactions between users.

SECTION 11Governing law and competent authority

The ClickChat party to this agreement is KolekciApps LLC, a limited liability company incorporated under the laws of the State of Wyoming, United States of America; its correspondence address is Cheyenne, Wyoming, USA. The company is not established in Turkey.

As the App is offered to users in Turkey in Turkish, the mandatory consumer protection provisions of Turkish law continue to apply to consumers whose habitual residence is in Turkey. No provision of this agreement may be interpreted in a way that removes or limits the protection afforded to you by those mandatory provisions. In matters falling outside that scope of protection, the agreement is governed by the laws of the State of Wyoming.

As a consumer, your right to apply to the Consumer Arbitration Committee or the Consumer Court of your place of residence is reserved. In cases where you are not deemed a consumer, the courts of the State of Wyoming have jurisdiction over any disputes that arise.
